Cookie-judgment – European Court of Justice (ECJ)

On October 1, 2019, the European Court of Justice (ECJ) in Luxembourg passed a far-reaching judgment concerning the placing of cookies on the computers of internet users.

The ECJ has ruled that users can no longer be shown pre-made cookie banners which they only need to confirm. Even though users can refuse the use of cookies by removing the tick in the relevant box, this is not sufficient according to the judgement. (Go to judgment.)

According to the ECJ, placing cookies that are not strictly necessary requires the users’ active and express consent. This means that they must give their consent by ticking the relevant box. This applies irrespective of whether the stored data are personal.

Therefore, many websites with cookie banners violate applicable European law and need to be adapted. 

We have adjusted the cookie settings of WP-ImmoMakler® accordingly and have expanded them by an interface to Borlabs Cookies, which can be downloaded with the 5.13 update. If you have any questions, please feel free to contact us.
